A New York man was facing drug charges on Jan. 3 after authorities conducted a traffic stop on his vehicle. The 30-year-old man was charged with four counts of third degree criminal sale of a controlled substance and five counts of possession of a controlled substance.
Albion police and the Orleans County Sheriff’s Office major felony crime task force pulled the vehicle over on West Avenue in Albion. During the stop, authorities reportedly found a large amount of crack cocaine that appeared to be packaged for sale. He was arraigned in the Town of Gaines Court. He was being held without bail due to the fact that he had a previous criminal history.
The state of New York takes accusations of drug possession and drug trafficking seriously. As a result, those who are facing charges for drug crimes could be sentenced to time in jail, probation, community service and other legal consequences. However, the punishments often do not stop there. In many cases, those who are simply accused of drug crimes could lose their jobs, housing and other benefits that they rely on, even if they are ultimately not convicted.
Depending on the evidence against an accused person, a criminal law attorney may use certain defense strategies. In some cases, for example, the attorney may find fault in the police investigation that led to the charges. If a person was charged after a traffic stop, the attorney could potentially argue that the traffic stop and vehicle search was illegal and that the accused person’s rights were violated.
