New York music lovers may be interested to learn that, on July 15, pop star Aaron Carter was taken into custody in Georgia on suspicion of drunk driving and drug possession. The 29-year-old singer and brother to Backstreet Boys’ Nick Carter was facing charges for DUI, possession of less than 1 ounce of pot and possession of drug paraphernalia following the incident.

Carter was reportedly detained at about 9 p.m. in Habersham County. In a statement, Carter and his girlfriend said that the vehicle was driving had had a new tire put on, causing the vehicle to be out of alignment. He had stopped at an AutoZone to see if the issue could be fixed. He claimed that he was detained while still inside the store and officers did not see him actually driving.

A sheriff’s deputy, on the other hand, said that a motorist called 911 after watching Carter’s vehicle drive all over the road. A deputy observed Carter behind the wheel before he pulled into the AutoZone parking lot. Further, although Carter reportedly does have a prescription for medical marijuana, the specific type of marijuana he had in the vehicle was not legal in the state.

In New York, those accused of being involved in drug crimes could face life-impacting legal consequences, including a prison sentence and fines. However, a criminal law attorney could mount a strong defense against the charges. If drugs were found in the accused person’s vehicle, for example, the attorney may argue that authorities did not have probable cause to search the vehicle, meaning the evidence would be inadmissible in court. The attorney may also argue that the drugs did not belong to the person, especially if the accused person did not own the vehicle.
